Genuine Matches Membership Agreement

Effective Date: May 15, 2025

This Membership Agreement (“Agreement”) is entered into between Genuine Matches (“Company,” “we,” “our,” or “us”) and the individual subscriber (“Member”). By subscribing to Genuine Matches and checking the box “I have read and agree to the Terms of Use, Privacy Policy, Disclaimer, and Membership Agreement,” the Member agrees to be legally bound by the terms outlined herein.

This Agreement is supplemented by our Terms of Use, Privacy Policy, Cookie Policy, and Disclaimer, which collectively govern your use of the platform.

1. Christian-Based Mission & Membership Eligibility

1.1 Faith-Based Focus

Genuine Matches is a private, Christian-based matchmaking platform rooted in biblical principles. It is designed exclusively for individuals seeking a committed, lifelong marriage between a biologically born man and a biologically born woman.

1.2 Traditional Marriage Framework

By accepting this Agreement, the Member affirms that:

They are a biologically born male or female;
They are seeking a lifelong relationship with someone of the opposite biological sex;
They understand and accept that the platform strictly adheres to Christian teachings on love, relationships, and marriage.

Genuine Matches reserves the right to deny, suspend, or terminate membership for individuals who do not align with this mission or misrepresent their identity or relationship intentions.

1.3 Age & Marital Status

Members must be at least 18 years old and legally single (not currently married, even if separated). Misrepresentation of age or marital status is grounds for immediate termination without refund.

1.4 Right to Refuse

The Company reserves the right to deny, suspend, or terminate any Membership at its sole discretion if a Member’s values, identity, or conduct conflict with the platform’s mission or eligibility standards.

2. Membership Fees & Legal Rights

2.1 Membership Tiers & Fees
We offer three membership levels:

2.1.a Apply Free Application

$0 annual fee; no auto-renewal.
Fill out an Application for submission.
No private introductions or matches—upgrade required for matchmaking.

2.1.b. Activated Matching Membership

$197.00 USD/year.
All Apply Free Tier benefits, plus private introductions based on compatibility and values.
12‑Month Match Guarantee.
Auto‑renews annually at the then‑current rate unless canceled 30 days before renewal.

2.1.c. Concierge Experience Membership

$1,497.00 USD/year.
All Apply Free and Activated Matching Membership benefits, plus priority introductions, concierge support, and exclusive events.
Auto‑renews annually at the then‑current rate unless canceled 30 days before renewal.

2.2 Payments & Cancellation
All fees are billed immediately upon signup. To cancel auto‑renewal, notify concierge@genuinematches.com at least 30 days before your anniversary date. All payments are non‑refundable, except as required by law.

2.3 Binding Nature
All Members, by joining and using the platform, are legally bound by this Agreement and all other governing policies, regardless of promotional pricing. This ensures the legal protection of the Company and its Members.

2.4 Chargebacks & Waiver of Rights
By purchasing a membership to Genuine Matches, you expressly agree that all fees are non-refundable and you waive any right to initiate a chargeback with your credit card issuer or financial institution.

You acknowledge that:

You are receiving access to a digital matchmaking service immediately upon payment.
You have reviewed and agreed to the Terms of Use, Membership Agreement, Privacy Policy, and this chargeback waiver prior to purchase.
You understand and accept that dissatisfaction, lack of matches, early cancellation, or subjective expectations do not constitute valid reasons for a refund or chargeback.

If you dispute a charge with your financial institution, you authorize Genuine Matches to submit this Agreement, your electronic acceptance, and evidence of your access to the service as proof that the charge was legitimate and fully authorized by you.
You further agree that initiating a chargeback violates this legally binding Agreement and may result in:

Immediate termination of your account
Collection efforts
Legal action to recover funds, fees, and damages

This clause survives termination and applies to all payments made to the Company.

3. Matching Process & Member Interaction

3.1 Private Introductions

There are no public profiles. The Company privately introduces Members based on compatibility, faith, values, and life goals.

3.2 Communication

Members receive an email when a match is found. A secure link allows private messaging within the platform. Only verified photos and minimal information are shared until both Members choose to exchange contact details.

4. Member Conduct & Platform Safety

4.1 Responsibility for Interactions

Members assume full responsibility for their own communications and any meetings arranged.

4.2 No Liability for Damages

The Company is not liable for any harm, including but not limited to fraud, harassment, emotional distress, mismatches, financial loss, or physical harm.

4.3 Prohibited Conduct

Prohibited behaviors include:

Harassment or abuse
Misrepresentation
Promoting products/services
Violations result in immediate termination without refund and may trigger legal action.

5. Termination of Membership

5.1 Company Rights

Membership may be terminated or suspended at any time, without notice, for any breach or conflict with our values.

5.2 No Right to Appeal

Termination decisions are final. Members waive any legal or administrative appeal rights.

6. Indemnification

Members agree to indemnify the Company against any claims, damages, or losses arising from:

Use of the platform
Violations of this Agreement
Interactions with other Members

7. Confidentiality

Members must keep all proprietary Company information confidential during and after Membership.

8. Intellectual Property

All content, code, algorithms, and systems are the property of the Company. Unauthorized use is prohibited and subject to legal action.

9. Disclaimers

9.1 As-Is Service

The platform is provided “as is” without any guarantees.

9.2 No Outcome Guarantee

The Company does not guarantee any match, relationship, or marriage. Testimonials are illustrative only.

9.3 No Medical or Psychological Advice

Any lifestyle or wellness suggestions are general and non-professional. Always consult a qualified provider.

9.4 Cyber Liability

The Company is not responsible for data breaches beyond its reasonable control.

10. Morality Clause

Conduct that conflicts with the Christian-based mission—whether on or off the platform—may result in immediate termination without refund.

11. Limitation of Liability

Total liability is limited to fees the Member paid to the Company in the prior 12 months. The Company is not responsible for indirect or consequential damages.

12. Force Majeure

The Company is not liable for service disruptions due to events outside its control, including natural disasters, war, or technical failures.

13. Governing Law & Dispute Resolution

13.1 Governing Law

Minnesota law governs this Agreement.

13.2 Binding Arbitration

Disputes will be resolved through binding arbitration in Minnesota under AAA rules.

13.3 Class Action Waiver

Members may not bring class or collective actions against the Company.

13.4 No Appeal of Arbitration

Arbitration decisions are final and cannot be appealed.

14. Non-Disparagement

Members agree not to publicly defame, disparage, or negatively comment on the Company, its staff, or other Members during or after Membership. Violations may result in legal action.

15. Severability

If any provision is found unenforceable, the remaining provisions shall remain in effect.

16. Entire Agreement

This Membership Agreement, together with the Terms of Use, Privacy Policy, Cookie Policy, and Disclaimer, constitutes the full and binding agreement between the Member and the Company regarding participation in the platform.

17. Amendments

The Company may revise this Agreement at any time. Continued use of the platform constitutes acceptance of any updates.

18. Final Acknowledgment

By subscribing, the Member affirms that they:

Have read and agree to all terms.
Understand this is a legally binding contract.
Accept full legal responsibility for their use of the platform.
Acknowledges, accepts, and agrees to all terms in this Agreement, fully understanding that they waive any claims against the Company and are committing to a legally binding contract. The Member acknowledges that they have had the opportunity to review this Agreement thoroughly, seek legal counsel if desired, and fully understand its binding nature.

19. Survival

Provisions regarding indemnification, confidentiality, dispute resolution, non-disparagement, and limitations of liability shall remain in effect after Membership ends.
